Terms Of Service

These Terms of Service (“Terms”) govern your access to and use of our Site and any related services offered through the Site, including contact forms and communications (together, the “Services”). The Services are provided by Hye Cemetery Brokers, Inc. (“Hye,” “we,” “us,” or “our”).

By using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site.

1. Who We Are; Important Disclosures

Hye is an independent California-licensed cemetery broker (License CEB 1489). We help connect buyers and sellers and coordinate lawful private resale/purchase of interment rights (for example: burial plots, crypts, niches), subject to cemetery rules and applicable law.

We are not owned by, affiliated with, sponsored by, or endorsed by any cemetery or funeral home. Any cemetery names, locations, or sections referenced on the Site are used only for factual identification and do not imply endorsement or affiliation.

2. Website Use Does Not Create a Client Relationship

Using the Site, submitting a form, or contacting us does not by itself create a broker-client relationship or obligate us to represent you.

Any brokerage representation, listing services, transaction services, or program terms will be governed by a separate written agreement signed by the required parties. If there is a conflict between these Terms and a signed written agreement, the signed agreement controls for that transaction.

3. Eligibility

You must be at least 18 years old to use the Site or Services. By using the Site, you confirm you are at least 18 and legally able to enter into a contract.

4. Permitted Use; Prohibited Conduct

You may use the Site only for lawful purposes and for personal, non-commercial use related to cemetery property inquiries.

You agree not to:

  • Provide false, misleading, or incomplete information
  • Impersonate others or misrepresent your identity or authority
  • Violate any law, cemetery rules, or third-party rights
  • Attempt to access systems, accounts, or data without authorization
  • Scrape, harvest, or collect information from the Site without permission
  • Upload or transmit malware, spam, or harmful content
  • Interfere with the Site’s operation or security
  • Harass, threaten, or abuse any person

We may suspend or block access if we reasonably believe these Terms were violated.

5. Information You Submit; Seller Authority; Verification

If you submit information to us, you agree that:

  • The information is accurate to the best of your knowledge
  • If you are a seller, you are the owner of the interment rights or have legal authority to act for the owner
  • If you are acting for someone else (estate, trustee, power of attorney, family representative), you have authority to communicate and share information
  • You will provide reasonable documentation if needed for verification (ownership, authority, property details)
  • You will not submit highly sensitive personal data through basic web forms (for example: Social Security number) unless we specifically request it and provide a secure method

6. Communications Consent

By providing your phone number and/or email, you consent to receive communications from us about your inquiry and our Services, including calls, emails, and texts.

You are not required to consent to marketing messages as a condition of receiving services.

If marketing messages are sent:

  • Emails: you can unsubscribe via the link in the email
  • Texts: you can opt out by replying STOP (or as instructed)

Message and data rates may apply.

Calls may be monitored or recorded where permitted by law, with notice where required.

7. No Guarantee of Results; Programs May Change

Any statements on the Site about “fast sale,” “buy-back,” “free listing,” timelines, or pricing guidance are general information and not a promise.

  • All programs are subject to eligibility, availability, cemetery rules, and our review
  • We may modify, pause, or discontinue programs at any time
  • We do not guarantee a sale, purchase, transfer approval, specific timeline, or any price

8. Cemetery Rules Control; Third-Party Fees and Approvals

All interment rights transactions are subject to cemetery requirements and applicable law, which may include:

  • Cemetery verification, approvals, and procedures
  • Transfer paperwork and signatures
  • Transfer/recording fees and other cemetery fees
  • Changes to cemetery rules, pricing, and availability

We do not control cemeteries and cannot guarantee any cemetery decision, approval, timing, or fees.

9. Intellectual Property

The Site and its content (text, graphics, logos, design, photos, and other materials) are owned by us or our licensors and protected by intellectual property laws.

You may view the Site for permitted purposes. You may not copy, reproduce, modify, distribute, or exploit any content without our prior written permission, except where allowed by law.

10. Third-Party Links

The Site may link to third-party websites or services. We do not control them and are not responsible for their content, privacy practices, or terms. Your use of third-party sites is at your own risk.

11. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, error-free, or that information will always be complete or current.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Hye and its owners, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or Services.
  • Our total liability for any claim related to the Site or Services will not exceed the greater of (a) $100 or (b) the amount you paid us (if any) for the Services directly related to the claim in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some parts may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Hye and its owners, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or Services
  • Your violation of these Terms
  • Your violation of law or third-party rights
  • Any false, misleading, or unauthorized information you provide

14. Governing Law; Venue

These Terms are governed by California law (without regard to conflict-of-law rules). Unless arbitration applies, you agree that disputes will be brought in state or federal courts located in Los Angeles County, California, and you consent to jurisdiction and venue there.

15. Dispute Resolution and Optional Arbitration

Either you or Hye may elect binding arbitration for eligible disputes, except:

  • Small claims matters (if eligible), and
  • Requests for injunctive relief related to misuse of intellectual property or security

If arbitration is elected:

  • It will be on an individual basis (no class, collective, or representative actions)
  • The arbitrator may award relief available in court, but only for the individual parties
  • The location will be Los Angeles County, California, unless the parties agree otherwise or remote arbitration is appropriate

16. Changes to These Terms

We may update these Terms from time to time. The Effective Date will change when updated. Continued use after changes means you accept the updated Terms.

17. Termination

We may suspend or terminate your access to the Site if we reasonably believe you violated these Terms or used the Site unlawfully.

18. Severability

If any part of these Terms is found unenforceable, the rest remains in effect.
